I recently moved here in Massachusetts, but I’m from Texas originally. I’m planning to buy a car here, but I have an unpaid traffic violation in Texas. Will this affect my car insurance application?

Linda

Cambridge, MA

You can get car insurance coverage in the State of Massachusetts even if you have traffic tickets that you have not paid yet in the State of Texas provided that your Texas driver’s license was not suspended because of this. In most states, and Massachusetts is included, if you fail to pay your traffic tickets, penalties ranging from driver’s license suspension to vehicle registration suspension may be ordered against you. If this happens, then you would need to take care of both paying the traffic ticket and having your driver’s license and vehicle’s registration be reinstated for you to legally drive again. Also, car insurance companies will not grant you any coverage if you are not able to provide them with a full valid license and vehicle registration.

In the State of Massachusetts, a single parking ticket can prevent you from renewing your driver’s license and/or vehicle’s registration. To keep your license from being suspended, it is best that traffic tickets be taken care of as soon as possible. You can either pay the fine or choose to fight it in court. If a conviction is issued against you, try to have a settlement with the court. Most states, including Massachusetts, will allow you to take traffic school so as to have the points against your driving record be reduced. Keep in mind that tickets received from outside the State of Massachusetts will be reported anyway and will be put against your Massachusetts driving record and will be treated as if the violation took place in this state. Although Massachusetts is not a member of the Drivers License Compact (DLC), this state has arranged to share criminal violation and driving record violation with other states, and Texas is one of those states.

Reader’s Question:

What will the penalty be for a minor that is driving with no license and no insurance and hits someone?

Gerald

Thank you for asking Gerald.

It varies from state to state when it comes to penalties for driving without an insurance or a valid license. The penalties may include fines, jail time, community service, vehicle impoundment, license and registration suspension to name a few. Some states may do a combination of these punishments.

The consequences for this conviction is considered a serious offense especially if you got involved in an accident and do not have insurance. You may have to comply with the financial responsibility laws. This will also includes having to pay for any injuries or damages from the accident out of your own pocket.

These types of violations as a minor may permit your state’s licensing department to delay your application for driver’s license from going through once you do apply. In addition to that, these convictions will likely go on your driving record. Even being a minor without a license does not stop your state from starting a driving history to record these infractions.

If you were convicted for these offenses, to make sure what your penalties are , contact the court listed on your ticket and/or your state’s Department of Motor Vehicles.

Reader’s Question:

When I was 16 I received a ticket for driving without a license. Im 18 years old now and have been residing in Oklahoma for the past 2 years. I want to apply for the Oklahoma drivers license. Are they going to be able to know the ticket I received 2 years ago? Can I still apply for a license in my new state? Thank you.

Erwin

Thank you for asking Erwin.

It seems like you were convicted for driving without a license and without insurance when you were in Ohio. Even though you are a minor, if you drive without a driver’s license, Ohio could have started a driving record for you already and included these infraction. You will likely going to get points and convictions added on your MVR before you even have a license.

Its best if you took care of your ticket in Ohio previously by going to court or other means than you should contact the OH Bureau of Motor Vehicles (BMV) to straighten this out. If you ignored the conviction or moved to Oklahoma before your offense were handed out you need to take care of them now. You may contact Ohio’s BMV to make sure how to reinstate your license from suspension, so that you can obtain an OK license.
